一、什么是美国EB-3移民?
美国的职业移民第三优先类，也就是专业人士所说的EB-3是什么呢?

EB-3:Employment-Based Immigration: Third Preference
简介：美国EB3移民：即美国雇主担保移民，是移民栏里的第三类，是美国移民法sec.203(b)(3) 规定认可，只要获得美国雇主长期的就业担保许可，就可以获得劳工卡并申请移民。所以只要是美国任何一个有规模的雇主作出长期工作的担保许可，提交移民局审批通过，即可获得美国EB3移民签证。
二、什么人可以申请美国EB3移民?
You may be eligible for this immigrant visa preference category if you are a skilled worker, professional, or other worker.
如果你是技术工人、专业人才、其他工人你可能适合这类优先类别的移民签证。另译为：要是你是一个熟练的，专业的技工，或其他工作人员，您就有资格获得这个类别的移民签证类。
1、“Skilled workers” are persons whose job requires a minimum of 2 years training or work experience, not of a temporary or seasonal nature
2、“Professionals” are persons whose job requires at least a U.S. baccalaureate degree or a foreign equivalent and are a member of the professions
3、The “other workers” subcategory is for persons performing unskilled labor requiring less than 2 years training or experience, not of a temporary or seasonal nature.
1、“技术工人”是那些技能最低要求有2年工作或者培训经验的而且不是一个从事临时的或季节性的工作的工人。
2、“专业人才”是那些工作要求至少是美国学士学位或者国外相当的学历并且是专业的一员。
3、“其他工人”子类别是为那些进行不熟练工人要求少于2年培训或者经验的人，且不是一个从事临时的或季节性的工作的工人。
另译为：
1、“技术工人”工作需要至少2年以上工作经验或培训，而且不是临时性或季节性的。
2、“专业人员”需要至少一个美国学士学位或相等的外国学历，而且是具有相关专业工作经验的人士。
3、“其他工人”的类别是适用于非技术的劳动力人士，不需要至少2年的工作经验或培训，而且不是临时或季节性的工人。
三、美国EB-3移民申请资格要求标准是什么?
1、美国EB3移民第一类，“技术工人”的要求：
(1)You must be able to demonstrate at least 2 years of job experience or training。
你必须能证明至少有2年工作或者培训经验。
(2)You must be performing work for which qualified workers are not available in the United States。
你必须胜任该工作，且在美国本土无法聘请到这样的工人。
2、美国EB3移民第二类，“专业人才”的要求：
(1)You must be able to demonstrate that you possess a U.S. baccalaureate degree or foreign degree equivalent, and that a baccalaureate degree is the normal requirement for entry into the occupation.
你必须能只能证明你拥有一个美国的本科文凭或者国外同等学历，并且一个本科学历专业要与工作领域相符合。
(2)You must be performing work for which qualified workers are not available in the United States。
您必须能胜任专业的工人，且在美国本土无法聘请到这样的工人。
(3)Education and experience may not be substituted for a baccalaureate degree。
教育和经验不能被本科学历所替代。
3、美国EB3移民第三类，“其他工人”的要求：
You must be capable, at the time the petition is filed on your behalf, of performing unskilled labor (requiring less than 2 years training or experience), that is not of a temporary or seasonal nature, for which qualified workers are not available in the United States.
当时代表你提出申请时，你必须是有能力胜任非技术工作的工人(需要不少于2年的培训或经验),并且不是一个临时的或季节性的工作，且在美国本土无法聘请到这样的工人。
注：以上三类均需要满足同样的条件：Labor certification and a permanent, full-time job offer required.即劳工认证和提供永久的全职工作。需要雇主申请劳工许可证和提供长期的、全职的工作承诺。
Note: While eligibility requirements for the third preference classification are less stringent, you should be aware that a long backlog exists for visas in the "other workers" category.

四、美国劳工部 - 劳工许可证U.S. Department of Labor – Labor Certification
Third preference petitions must generally be accompanied by an approved, individual labor certification from the Department of Labor on Form ETA-9089. In some cases, the petition may be submitted to U.S. Citizenship and Immigration Service (USCIS) with an uncertified ETA-9089 for consideration as Schedule A, Group I. 五、美国EB3移民签证家庭成员持有签证情况Family of EB-3 Visa Holders
Your spouse may be admitted to the United States in E34 (spouse of a“skilled worker”or“professional”)or EW4 (spouse of an“other worker”).During the process where you and your spouse are applying for permanent resident status (status as a green card holder), your spouse is eligible to file for an Employment Authorization Document (EAD). Your minor children (under the age of 18) may be admitted as E35 (child of a “skilled worker”or“professional”) or EW5 (child of an “other worker”).
